The Dunker Journal Web Site, www.dunkerjournal.com, or related sites, (herein the "Site") is an online information service provided by Dunker Journal and is subject to the terms and conditions set forth below. Please read this information carefully before accessing or using or linking to the Site. If you do not accept the terms and conditions stated here, do not use the web Site.

Dunker Journal adheres to a conservative Anabaptist and evangelical Christian worldview. You may find such a worldview and its attendant opinions and doctrines offensive and politically incorrect. If so, do not use the Site.

By visiting, reading, linking to, quoting, printing out, or in any way making use of the Dunker Journal web Site's content in any means, place, or forum, you agree to the following:

Dunker Journal may use any comments or contact information, whether from direct communication or on third-party sites or discussion fora. Your contact information will not be sold to other organizations; however, should Dunker Journal believe someone else may better serve you, we may give your contact information to other organizations. Dunker Journal may use the information it obtains relating to you, including your IP address, name, mailing address, email address and use of the Site, for internal business purposes. You may not 'adorn' the link in such a way as to imply an endorsement, ownership and/or sponsorship of the Site or materials contained on the Site. By linking to the site, you agree that the Terms of the Site supersede any and all terms stated or implied on third party web site containing the link. By linking the site, you agree to relinquish any and all claims of ownership, rights to use, permissions and/or licenses to the intellectual property rightfully owned by the Site.

In exchange for the access to the Site content, you agree not to sue or harass Dunker Journal, its webhosting provider(s), and/or its webmaster for its content, whether original or linked or quoted from another source, in any court, or in any venue, including ecclesiastical hearings, on any grounds whatsoever in law or equity. You agree to defend, indemnify, and hold harmless Dunker Journal, its webhosting provider(s), the officers, directors, employees, relatives, friends, and agents, from and against any claims, actions or demands, including without limitation, reasonable legal and accounting fees, alleging or resulting from your use of the Site or your violation of the terms or conditions of this agreement. You agree not to use material on the website in any fashion to hinder or obstruct Dunker Journal, its webhosting provider(s), its webmaster(s) officers, directors, employees, relatives, friends, and agents from receiving contributions or compensation through the Church of the Brethren or any of its congregations. Should you violate this agreement, you agree to pay Dunker Journal the sum of one hundred thousand dollars ($100,000) as liquidated damages. Unless otherwise expressly provided, the aggregate liability for Dunker Journal to you for all claims arising from the use of this website is limited to $0.01 (U.S.). If for any reason a court of competent jurisdiction finds any provision or portion of the Terms of Service to be unenforceable, the remainder to the Terms of Service will continue in full force and effect. Should this agreement not to sue be held unenforceable by a court of competent jurisdiction, you agree to binding arbitration, with all arbitration expenses to be paid by you. The arbitration panel shall be composed of three (3) weblog operators selected by Dunker Journal's owners or operators from those in the links list on the Dunker Journal site. The award in such arbitration shall be limited to (1) a monetary sum not to exceed $10; and (2) the publication of a retraction on the Dunker Journal site. Should this arbitration provision be held unenforceable in a court of competent jurisdiction, you agree to accept as liquidated damages in any lawsuit against Dunker Journal the sum of ten dollars ($10), and you agree that you will be entitled to no other relief of any kind in law or equity. You agree that all disputes concerning these terms of use or the content of DunkerJournal.com are to be resolved in the courts of Noble County, Indiana, under the laws of Indiana and the United States of America.

If you do not agree to these terms of use, exit the Site immediately, destroy all copies of Dunker Journal content remaining in any form on your computer, any other computer or network device under your control, in print form, or on any information storage or retrieval device that you possess or control.

These Terms of Service will be governed by and construed in accordance with the laws of the State of Indiana.

These terms of service may be changed at any time without notice.
